My case is not premium processing and the online status changed to "approval notice sent " for 4 days before the status changed to " document sent ". Its an I 140 and I heard that the mistake was restricted to PP cases . So I do not think that is the issue . Some one said it could be the last status on an approved I 140

I am planning to apply my Green card. However I am a bit confused which category will I fall to ? EB2 or EB3 ?
As per my job requirement details, it is as below:
i ) Bachelor degree in technology related field.
In the detailed experience seeked, it says as below:
i) Five years of experience with installing, maintaining servers.
ii) Three years of practical experience in routing and network security.
I have more than 5 years of working experience (which they seeked) before I started this job.
Under which category will it fall under, EB2 or EB3 ?

Here is my question. In my college days bacd in the early 90's and mid 90's, I used to work and worked with my original Social secuirty number. Another words, I was given pay checks. I paid taxes and got refunds as well. Obviouslly all illegal since I had no permission to work as I was on FI visa. Anyways, after graduating college, I got H1b visa. Now I am in my 9th year, and my labor and I140 have already been approved. So the question is, when I am called for my 485 interview, will they know that i worked illegally, will they have records of that. I also have a DWI. I think DWI is ok, as I have read many got their green cards after this. I am more concerned with my working illegally.
Just recentlly I was sued by Discover card. The judgement against me in teh court was for 10,000 +. I have paid half of it and will pay the rest in 6 months. Will that affect my Green Card.
Please eloborate.

Hi,
Couple of things he need to check.
1) Annotation on the visa i.e the name of the company sponsoring the visa or its blank.
2) Is it B1, B2 or B1/B2
B1 is for business where as B2 is for Visiting. B1/B2 allows both.

My attorney is encouraging me to take part in the proposed AILF Class Action Lawsuit against the Government by submitting I-485 to USCIS knowing that its going to be rejected. Anyone decided on this? What are the pros and cons? If there is a favorable outcome, I-485 may be accepted at that time (months? / years?). But here is my big concern: if I am a part of that lawsuit, my 485 may be considerably delayed (my PD is Feb 2005) ! I am aware that IV is encouraging lawsuit too. Any comments?

I want to understand the process so I can know the meaning of the Visa bulletin based on my situation.
I am guessing that right now I will have to wait for my i140 to be approved first before I can talk about i485. I checked the processing time for i140 at TSC and it is August 15, 2007. Any crazy estimate when I should get the approval?
Once my i140 is approved then I can look and match my PD with the visa bulletin EB3 ROW for adjustment of status.
I know there would be some more steps than these above. But are these statement above correct/incorrect?

Graduated from college last year, finally found a job that I really like. Currently on OPT. Just curious to know how long will it take for employer to apply for labor and I-140.
I know most of you are thinking - "are you mad, esp with current gc situation? " the thing is I like it here. My relatives and friends are here. I am hoping that with so many people stuck in the gc process, somebody has to fix it soon - and I (& other newcomers) will benefit from better immigration policy.

The court is saying that since this is a non-binding memo; the court does not need to judge whether or not the USCIS definition of an employer employee relationship is valid or not.
It just means that H1B petitions that have denied based on the 'control' issue can be appealed presumably. But this might only be an option for large IT companies; which is probably what the USCIS knew and planned for all along. I think the goal of the USCIS is to apply this memo selectively against the smaller Desi consultancies.

I will be remoting in from a different state. My employer would not file a new labor condition application which is required.
If the employer is the same and working remotely is an option, then why move from H1B to EAD. Why not keep the current status (full time) and work remote?

The other day had a friend at my place and I felt like throwing him out of my house. These guys are crying by their asses days and night. Believe me he is the guys whose wife drives him to work because his DL expired and PA DOT is not issuing him License because he has less than 1 year visa. But he was talking this government, that government..... I asked him to keep quiet and watch, if we are successful you'll get a free ride, if not then keep crying through your ass, you're doing it anyway!!!!

With the elections changing the senators..we have to contact the new senators to pass our bills..so we need to write to new and important senators to pass the Bills...I was wondering if anybody had a list of new senators and thier addresses so that we would write a letter...sign in by hand and post...I have allways seen that sending sending Fedex is better that sending 37 cents stamped letter...but at least we should send in the 37cent letter..

My wife is working on EAD and her EAD is expiring begining of next month. New EAD has been applied. Can she work with the EAD renewal receipt if the EAD expires ? What are the possible options ? Pleas help
