You analysis is inaccurate and misguided.

Look at the top table which shows data released by DOS. Last month 75 application have been reduced and in month back 100 applications were reduced.

This is really really bad sign for EB3 and even for EB2.

Hello All,

I want to file EAD and AP for the first time ( did not apply in July 2007 )without attorney (self file), Could someone please help me in understanding if Efile is better or paper filing ?.

Also, Could you please let me know from where I can find latest EAD and AP forms and documentation required to be sent along with EAD and AP applications.

I am planning to work on EAD soon and switch my employer using AC21. How would USCIS know that I have switched from H1b to EAD. I might change my mind after 1 months and get back to H1 transfer and work on H1 instead on EAD.

This depends on if the future project is long term and I switch to H1B just to be safe.

Any ideas would be appreciated...

To All,

I Am Planning To Goto India And Re-enter Usa Using Advance Parole And My H1-b Visa Stamp Has Been Expired In The Passport. Originally, I Planned To Travel By Air-india From Newark, Nj To Mumbai. The Flight Will Stop Over In Paris For 3 Hours.

When I Contacted Air-india, They Said That Transit Visa Is Not Required. I Contacted French Consulate And They Said That I Need To Have Transit Visa If I Am Travelling With Advance Parole And Expired H1-b Visa. Is This True?

The Only Other Option Left For Me Is To Fly From Jfk To Mumbai.

my Question Is When I Am Entering Usa (poe � New York) Using Advance Parole,

If I Use Advance Parole, Will There Be Any Problem With The Immigration Check In New York.
What Kind Of Questions Immigration Officers May Ask
What Are The Documents I Need To Show At Poe-new York.
Usually, Everybody Says That Poe-new York Will Scrutinize More Than Poe-new Jersey. Is This True? Did Anybody Faced Any Problems At Poe-new York.

Hello everyone,
My driver's license has come up for renewal in Feb 2009. I have 2 yrs EAD.I have send my H1 for renewal but it has not got yet approved..
My employer suggessted that I use my EAD card to get my license renewed. In Ideal case I would like to use my approved H1 to renew my license. However since its taking time for my H1 renewal can I use my EAD card to get my license renewed.

Thanks for your reply. what's the continuous employment criteria? Is the reason my attorney enter '5/17' instead of '5/15'?

I have a letter from HR and saying the last day at my previous company was '5/15'. very boring!!!!

All experience letters should indicate the last date of your employment as 5/15.

Recently I renewed my Advance Parole (AP), USCIS renewed it for 9 months only. Is it possible to check with USCIS to get a 1 year AP.

Ask your husband to contact a good lawyer like www.murthy.com or www.shusterman.com or www.immigration.com. You will have to pay for their services and I am sure you will get what you need. American Dream is not cheap for the first immigrants......There are tons of bad lawyers out there, so get your job done through a goood one.

I am posting this on behalf of a friend. They (husband/wife) got their green card approval last week, however they got 2 RFEs for their 2 kids. The RFE is about a vaccine called PNEUMOCOCCAL (PCV/PPV) that's not been administered for the kids. The RFE mentions the requirement for this vaccine but the doctor deemed it as NOT-AGE-APPROPRIATE in their filed medical forms.

Our guess is that when they actually administered the vaccine about a year or so ago, it was deemed "Not age appropriate" but now upon approval, the USCIS deems it necessary. I'd appreciate it if anybody with similar experience can post as to how they handled the situation or any insights into who to talk to is also much appreciated. The family is currently not in the country and therefore their options are limited in terms of talking to or meeting someone face to face. Also they need to respond to the RFE by June 24...

Hi,
I Think you need not worry. Air-india will stop in paris for 1 or 2 hours for fuel. They will not allow you to get down from flight. So, technically no stop in paris. I came through air-india last week. No need of french visa. Go by what air-india says. Regarding NJ-Newyork.. let others can answer. No problem as long as u have full AP Papers.

got to the SSN office with ur receipt, tell them you are waiting for ...... long for the card. you need the number to give to the employer. most of the officers would look in the system and would give you the number.

What I mentioned above applies to new H1 filing. The person can start working as soon as H1 is approved which can be as quickly as 15 days or less if done under Premium Processing.

People who have been counted against the quota in the last 6 years are exempt from it and can apply for new H1 with different employer without being subjected to the quota again.

you can also change employers immediately. Your spouse is the primary applicant, and hte 180 day AC21 rule applies to her. You can:
- use EAD whenever you want
- change jobs whenever you want
- change job profile however you want.

she:
- can use EAD whenever she wants
- change jobs after 180 days
- change onto a job in the same or similar profile.

I entered US in 2001 on H1B and have not left the country since then. Unfortunately within few months of coming to US, I had a fight with my wife and was charged of domestic violence. This charge was later reduced and I was convicted of a simple battery.
Now if I travel overseas and come back on AP (I intend to use my approved AP instead of going for H1B stamping), can I be denied entry to US at port of entry because of my criminal charge?
Anyone in the same situation or know someone in this situation? Was there any issue in there re entry into US?

Hello,

So let's say my PD is current and my processing date is current as well. The USCIS starts looking at my 485. While they're working on it, the PD retrogresses. Would they drop my application since my PD is no longer current or would it still continue to be processed since I've crossed the PD-current hurdle previously?

My mother-in-law also has plans to apply visitor visa. She is also a widower.

Is it risk if both my mother-in-law and grand mother (widower) go togethor for visa interview?
